The Posting of Workers Directive 1996, even though being 25 years old, is still a complex and highly polarizing issue, often connected to social dumping and unfair competition. This issue is representative of economic versus social integration. This dissertation aims to answer the research question “How has the Posted Workers Directive impacted the national labour policy of Germany in the construction work and meat industry sectors?”. This is an explanatory type of research following a comparative case study, where we will compare the construction sector and the meat industry in Germany. Data collected will both be qualitative and quantitative in a mixed method approach with triangulation of information. The observed time will cover the years from 1996, date when the German Posting Act came into effect, and 2015, when Germany implemented a statutory minimum wage. Posting remains a controversial topic, therefore this research hopes to shed some light on its impacts on national policies, with regards to collective bargaining, main legislation changes regarding labour mobility, and minimum wages. |

A diretiva relativamente ao destacamento de trabalhadores, apesar de ter 25 anos, é ainda um assunto complexo e polarizador, maioritariamente relacionado com dumping social e concorrência desleal. Este assunto é representativo da dinâmica entre integração económica e integração social. Esta dissertação propõe-se a responder à pergunta de investigação “Como é que a diretiva relativamente ao destacamento de trabalhadores afetou a política nacional de trabalho na Alemanha nos setores da construção civil e produção de carne?”. Esta questão dará azo a uma investigação explicativa e um estudo de caso comparativo, onde os setores da construção civil e da produção de carne na Alemanha serão comparados. A recolha de dados será tanto qualitativa como quantitativa, com uma abordagem mista e triangulação de informação. O período observado será desde 1996, data em que a Alemanha adotou a sua lei relativamente aos trabalhadores destacados, e 2015, data em que a Alemanha implementou um salário mínimo nacional. O destacamento de trabalhadores continua a ser um tópico controverso, deste modo esta dissertação almeja prestar algum esclarecimento no que toca ao seu impacto em políticas nacionais, no que toca principalmente à negociação coletiva de trabalhadores, mudanças legislativas de maior impacto no que toca à mobilidade de trabalho, e salários mínimos. |
