| مستخلص: | [ES] El presente trabajo de investigación centra su temática en la figura de la cadena de custodia, materia de gran relevancia y actualidad procesal. Tomando como base la pregunta de investigación: ¿Cómo ha de ser entendida la cadena de custodia en nuestro ordenamiento jurídico?, se examina el camino evolutivo de la institución en el plano jurisprudencial a fin de observar de dónde venimos y hacia dónde nos dirigimos. Se manifiesta, entonces, la necesidad de delimitar conceptualmente la cadena de custodia, que ha de ser entendida como una garantía de la prueba propia del proceso del siglo XXI [EN] This research work focuses on the figure of the chain of custody, a matter of great relevance and current procedural relevance. Based on the research question: How is the chain of custody to be understood in our legal system, we examine the evolutionary path of the institution in the jurisprudential level in order to observe where we have come from and where we are heading. The need to conceptually delimit the chain of custody, which is to be understood as a guarantee of the evidence proper to the 21st century process, is then expressed. |
