This article aims to study the new features incorporated into article 34.8 Status of workers after the reform operated by Royal decree law 6/2019. This Royal decree law has significantly modified the scope of the right of workers to adapt working hours to compatibilize work and family. It is a right whose exercise is generating an important controversy in companies as prove the number of judgment on the matter. Therefore, the analysis will be conducted from a very practical perspective to assess the scope of the 2019 reform through the interpretation that the Courts make of the right of adaptation. ; El presente estudio tiene por objeto el análisis de las novedades incorporadas al artículo 34.8 del Estatuto de los Trabajadores tras la reforma operada por el Real Decreto-Ley 6/2019, dado que esta norma ha modificado significativamente el alcance del derecho de los trabajadores a la adaptación de jornada para compatibilizar vida laboral y familiar. Se trata de un derecho cuyo ejercicio está generando una importante controversia en las empresas a la luz de las numerosas resoluciones judiciales en la materia. Por ello, el análisis se realizará desde una perspectiva muy práctica para valorar el alcance de la reforma de 2019 a través de la interpretación que los tribunales hacen del derecho de adaptación. |
