| الوصف: | Whenever reference is made to the legal subjects, the term is usually assimilated to the concept of person, understanding the latter as the only conception that exists within the category of subjects of rights without including other conceptions such as that of subject of legal relevance, subject of special protection, etc. Thus, the present work addresses the issues that revolve around the legal status of animals within the Colombian legal system, so as to make it possible to identify whether these can be recognized as subjects of rights and if, this recognition is possible, does it extend to all animals or it is diminish by the anthropocentric conception immersed in Colombian law, which constitutes legal barriers for the recognition of an animal legal subjectivity of all beings that have been historically subjected to human practices. ; Siempre que se hace referencia a los sujetos de derechos normalmente se asimila este con el concepto de persona, entendiendo a este como la única concepción que existe dentro de la categoría de sujetos de derechos sin que se incluyan otras concepciones tales como la de sujeto de relevancia jurídica, sujeto de especial protección, etc. Así pues, el presente trabajo aborda las cuestiones que giran en torno al estatus jurídico que poseen los animales al interior del ordenamiento jurídico colombiano, de forma tal que permita evidenciar si estos pueden ser reconocidos como sujetos de derechos y si en caso de ser procedente dicho reconocimiento, tal concepción es extensiva a todos los animales o esta se ve truncada a partir de la concepción antropocéntrica inmersa en el derecho colombiano, la cual se constituye como barrera legal para el reconocimiento de una subjetividad jurídica animal de todos los seres que históricamente se han visto sometidos a prácticas humanas. |
