| الوصف: | This article examines whether the Argentine Constitution and the international human rights treaties listed under article 75(22) adopt a position regarding the purposes of imprisonment, a question debated by scholars. In order to interpret article 18 of the Argentine Constitution, this article investigates its historical origins, provincial constitutions at the time of its enactment and its interpretation by scholars and courts. Regarding the international human rights treaties, the question is analyzed in light of the rules of interpretation of the Vienna Convention on the Law of Treaties and the jurisprudence of the Inter-American Court of Human Rights. ; En el presente trabajo se examina si la Constitución Nacional y los tratados internacionales de derechos humanos enumerados en su art. 75, inc. 22 adoptan una posición respecto de los fines de la pena privativa de la libertad, cuestión que es discutida en la doctrina. Al efecto de interpretar el art. 18 de la Constitución Nacional, se indaga en sus antecedentes históricos, en los textos constitucionales provinciales de la época y en su interpretación en la doctrina y jurisprudencia. También se analiza el texto de los tratados internacionales de derechos humanos a la luz de las reglas interpretativas de la Convención de Viena sobre el Derecho de los Tratados |
