Los procesos colectivos en general han tenido un importante desarrollo durante los últimos veinte años, a instancias de precedentes de la Corte Suprema de Justicia de la Nación. Subsisten conflictos entre la novedad procesal y los códigos rituales clásicos que el máximo tribunal argentino ha intentado subsanar mediante el dictado de acordadas que instruyen ciertas formalidades del proceso colectivo. A su turno, la acción de clase —adecuada al Derecho Argentino— presenta aún interesantes interrogantes en la práctica, entre los cuales se encuentra indudablemente el referido a la certificación de la clase, colectivo o grupo comprometido en el pleito. Ello lleva a otros cuestionamientos que, en ciertas condiciones, pueden colisionar con el derecho de defensa en juicio, con el acceso irrestricto a la justicia, o bien con otras garantías constitucionales. ; Collective processes in general have had an important development during the last twenty years, at the request of precedents of the Supreme Court of Justice of the Nation. There are still conflicts between the procedural novelty and the classic ritual Codes that the Argentine Supreme Court has tried to rectify through the issuance of agreements that instruct certain formalities of the collective process. In turn, the class action —adapted to Argentine law— still presents interesting questions in practice, among which is undoubtedly the one referring to the certification of the class, collective or group involved in the lawsuit. This leads to other questions that, under certain conditions, may collide with the right to defense in court, with unrestricted access to justice, or with other constitutional guarantees. ; Facultad de Ciencias Jurídicas y Sociales |
