In the last decades, the most important problems society faced at international level are often the individual autonomy and the free will. The thing that draws a great interest is drawing clear lines by reference to the liberty of the individual and to the existing legislative framework. Taking into consideration the great progress in medical, biological fields in the last decades, and reporting the progress to the dynamics of the society, and to the importance given to the human being as subject of law, in the present paperwork we decided to study the problem of respecting the rights and fundamental liberties of the human being from the perspective of donation and prelevation of human organs. This is why we decided to analyze by comparison concepts as: liberty - synthetic concept, liberty from the juridical point of view, the liberty to dispose of his own body, and the existing legislative framework. ; În ultimele decenii, cele mai importante probleme cu care se confruntă societatea la nivel internațional sunt adesea autonomia individuală și liberul arbitru. Lucrul care atrage un mare interes este trasarea unor linii clare prin referire la libertatea individului și la cadrul legislativ existent. Ținând cont de marele progres în domeniile medical, biologic din ultimele decenii, raportând progresul la dinamica societății și la importanța acordată ființei umane ca subiect de drept, în prezenta lucrare am decis să studiem problema respectării drepturilor și libertăților fundamentale ale ființei umane din perspectiva donării și prelevarii organelor umane. De aceea am decis să analizăm prin comparație concepte precum: libertatea concept sintetic, libertatea din punct de vedere juridic, libertatea de a dispune de propriul corp și cadrul legislativ existent. |
