When speaking of contemporary legal thinking, it is said that it is as much as speaking about the changes developed over the history in society. The legal aspects are coated with specific characteristics, transformations that transcend both the internal organization law systems and the organization of state government, so the shifting of the contemporary legal thinking has its beginnings in the Absolutist State, through the rule of law until the State Constitution, which is known as neoconstitutionalism. This is the result of people�s needs related to the respect of their fundamental rights protected by a supreme law, which is the Constitution. The existence of constitutional judges in the form of courts, has been a very controversial topic in our country about its justification, to the point that in those States where these courts have been institutionalized, there is no consensus on if their sentences are biding for the legal system, which is the aim of this article ; Hablar del pensamiento jurídico contemporáneo es tanto como hablar de los cambios que se han desarrollado a lo largo de la historia de la sociedad; a lo largo de la historia los aspectos Jurídicos, han estado revestidos de características propias, dichas transformaciones han trascendido tanto en la organización interna de los sistemas de derecho como en la organización de los poderes públicos estatales, por lo que se puede hablar del paso progresivo del pensamiento jurídico que tiene sus inicios en el Estado Absolutista, pasando por el Estado de Derecho hasta llegar al Estado Constitucional, el cual va entrando ya a un Neoconstitucionalismo como resultado de las necesidades de los ciudadanos relacionadas con el respeto de sus derechos fundamentales amparados en una norma suprema.
