| الوصف: | El presente artículo de revisión tendrá como eje fundamental la diferenciación de la jurisdicción ordinaria y militar, mirándose desde la función del juez natural de cada jurisdicción; para ello será necesarios adelantar una recolección de datos sistemática, encontrado un total de 1.190 artículos, de los cuales fue necesario filtrar los mismos y quedar únicamente con 22 artículos; dicho reducción en los resultados de la búsqueda se debió a la escasa información sobre el problema de investigación; para llegar a dicha búsqueda investigativa utilizamos diferentes bases de datos; como lo son: vlex, Leyex, Fuente Académica Plus, Academic Search Ultimate, Gale OneFile: Informe Académico, Complementary Index, Legal Collection, MedicLatina, Supplemental Index, Dialnet, JSTOR, EBSCO, SAGE, REDALYC, SCIELO, SIDALC, Biblioteca Virtual Miguel De Cervantes, Redalyc, Google académico, PROQUEST. El conflicto jurisdiccional es aquella facultad que tienen únicamente los jueces de diferentes órganos; si bien dicha asignación ha sido por mandato jurisprudencial; por cuanto solamente existirá colisión jurisdiccional cuando las partes así lo invoquen, entiéndase por parte a las jueces penales ordinarios y militares, si bien; los procesados dentro de la protección constitucional y legal, le es vedado implorar un conflicto, toda vez éste no está legitimado; situación que consideramos es inconstitucional. ; Universidad libre facultad de derecho especialización en derecho penal y criminología ; This review article will have as its fundamental axis the differentiation between military and ordinary criminal justice, looking from the function of the natural judge of each jurisdiction; for this it will be necessary to advance a systematic data collection, found a total of 1. 190 articles, of which it was necessary to filter them and be left with only 22 articles; such reduction in the search results was due to the scarce information on the research problem; to reach such investigative search we used different databases; such as: Vlex, ... |
