The article proposes an analysis of the situations that constitute the illegality of the coercive conduct of suspects or accused, seeking to understand the conflicts between this procedure and the fundamental rights of personality and human dignity. During the research, it was observed that there are considerable disagreements between the practice of coercive driving and the aforementioned rights. The text addresses these disagreements, highlighting the incompatibility of the procedure with individual guarantees. An emblematic case, which reached the UN Human Rights Committee, is presented to illustrate the potential violations occurring during coercive conduct, emphasizing the need for a critical analysis of this legal instrument. The deductive method used in the article starts from concrete situations to reach broader conclusions, relating coercive driving to violations of personality rights and human dignity. In conclusion, it presents suggestions for changes to the legislated system as a result. The work aims to contribute to the legal debate and the improvement of legal practices, highlighting the importance of reconciling the effectiveness of justice with respect for the fundamental rights of the individuals involved. ; El artículo propone un análisis de las situaciones que constituyen la ilegalidad de la conducta coercitiva de sospechosos los imputados, buscando comprender los conflictos entre este procedimiento y los derechos fundamentales de la personalidad y la dignidad humana. Durante la investigación se observó que existen considerables desacuerdos entre la práctica de la conducción coercitiva y los derechos antes mencionados. El texto aborda estos desacuerdos, destacando la incompatibilidad del procedimiento con las garantías individuales.
