| الوصف: | The purpose of this article is, initially, to make a panoramic exposition on the possibilities of the use of consensual solutions in criminal proceedings, to, later, focus on the Brazilian consensual institute, called the criminal non-prosecution agreement, examining the objective and subjective requirements, established by article 28-A of the Code of Criminal Procedure, also studying the conditions that can be established in that agreement, the need for its judicial approval, as well as the consequences of its fulfillment or breach. ; El presente tiene por objetivo hacer, inicialmente, una exposición panorámica sobre las posibilidades de configuración del consenso en el procedimiento penal, para posteriormente, centrar el foco en el instituto consensual brasileño, denominado de acuerdo de no persecución penal, examinando los requisitos objetivos y subjetivos establecidos por el artículo 28-A del Código de Proceso Penal, estudiando, también, las condiciones que se puede establecer en ese acuerdo, la necesidad de su homologación judicial, así como las consecuencias de su cumplimiento o incumplimiento. |
