الوصف: When the editors extended to me the invitation to contribute to a book in honour of Klaus Mathis, they made the helpful suggestion that my contribution could possibly address a topic on the law and economics of insurance. Having surveyed this field, I thought that an analysis of business interruption insurance as a measure of compensating losses resulting from the Covid-19 pandemic would be an interesting and novel topic to discuss.1 In the last few years, the question of whether and how business interruption policies may respond to pandemic-related losses has occupied courts, regulators, and scholars in several jurisdictions. While it appears prima facie a highly specific topic, it nevertheless addresses some of the core questions of insurance law and economics.
