| الوصف: | This article will present the “Ficha Limpa” Act and its considerable repercussions on the democratic regime in Brazil. The main goal of the article is to give out an analysis surrounding the adhibition of electoral detraction and how it affects the calculation of the period of ineligibility exposed on “Lei Complementar 64/90”. The deductive-thinking method was the one chosen to approach the subject. To start with, the author reveals a few general definitions of the democratic electoral procedure and political rights. Right after that, a more specific definition of electoral detraction will be presented, along with a brief review about its coherence with the clause mentioned above. In addition, it is important to mention the qualitative nature of the research, as well as its monographic method of procedure. Finally, by the use of bibliographical and documental sources, embedded in the roster of renowned legal opinions, the author will exhibit the final position as well as the final considerations that will likely advocate for an application of the electoral detraction. Furthermore, it is relevant to mention that because of the lack of legal procedure, the “Ficha Limpa” Act caused a disproportionality in the application of penalties in the Brazilian justice system. ; O presente estudo trata da Lei da Ficha Limpa e seus consideráveis reflexos sobre o regime democrático, tendo por objetivo a análise acerca da aplicação do instituto da detração no cálculo do período de inelegibilidade previsto no art. 1º, I, “e”, da Lei Complementar 64/90. Ao abordar o tema, utilizou-se do método de pensamento dedutivo, a começar pela exposição de conceitos amplos inerentes ao processo eleitoral democrático e os direitos políticos, até que se chegasse no exame específico do instituto da detração e sua aderência ao dispositivo em comento.
