| الوصف: | The objective of this article is to identify the main antecedents of the right to property in the republican constitutional history of the country, based on a review of fundamental aspects of the economic development of the country since the emancipation. Method: in order to fulfill the proposed objective, a documentary analysis methodology was applied to compile and study the bibliographic inputs and pertinent doctrine that allowed the identification of the fundamental elements. Results: it is evidenced how the understanding of the main precursors of the economic history of the country are associated to the evolution of the normative recognition of the right to property and have a significant impact on the construction that, on the occasion of 1991, experienced the law and modified its traditional absolutist vision. Conclusion: the process of normative foundation of the right to property can be seen in the consecration of this right in all the constitutional texts of the Colombian republican history, however, its study, until 1991, implied a reference to the Civil Code due to the absence of normative value of the constitutions and the need to guarantee great freedom in its exercise in order to allow the consolidation of a market economy. ; El artículo tiene como objetivo: identificar los principales antecedentes que, el derecho a la propiedad tiene en la historia constitucional republicana del país a partir de una revisión de aspectos fundamentales del desarrollo económico y constitucional de los siglos XIX y XX. Método: para cumplir con el objetivo propuesto, se hizo aplicación de una metodología de análisis histórico documental para compilar y estudiar los insumos bibliográficos y doctrina pertinente que permitiera identificar los elementos fundamentales, el enfoque es cualitativo, el alcance es exploratorio y correlacional y los método dogmático y hermenéutico crítico.
