| الوصف: | This article, which uses the analytical-critical method and a bibliographic and documentary research and review, of an exploratory nature, aims to demonstrate that biopower, from the perspective of Michael Foucault, proliferates among individuals and is applied in private legal transactions arising from the private autonomy, being necessary the intervention of the State in some situations, notably to protect the social function of the legal business, the good faith and the defense of the individual guarantees of the other contracting party. The principles of private autonomy and free competition will be balanced with the constitutional precepts of good faith and social function. ; O presente artigo, que se utiliza do método analítico-crítico e de uma pesquisa e revisão bibliográfica e documental, de cunho exploratório, visa demonstrar que o biopoder, na perspectiva de Michael Foucault, se prolifera entre indivíduos e é aplicado nos negócios jurídicos privados decorrentes da autonomia privada, sendo necessária a intervenção do Estado em algumas situações, notadamente para resguardar a função social dos negócios jurídicos, a boa-fé e a defesa das garantias individuais da outra parte contratante. Os princípios da autonomia privada e da livre concorrência serão ponderados com os preceitos constitucionais da boa-fé e da função social. |
