e ; i ; O presente artigo estuda o processo decisório das agências reguladoras e as novas perspectivas derivadas das últimas alterações legislativas. Através do método teórico-descritivo, apresentam-se as relações estabelecidas entre Direito, Economia e Regulação para se compreender as razões que levaram à institucionalização das Agências Reguladoras. Apresentadas as principais características dessas instituições, realiza-se o estudo do processo administrativo, definido como instituto jurídico que disciplina e estabelece o sequenciar de fatos e atos administrativos antecedentes à tomada de decisões pela Administração Pública. Assentadas as premissas, é explorado o processo decisório das Agências Reguladoras e os novos parâmetros legais que trouxeram contornos realista, consequencialista e eficientista ao atuar dessas Autarquias especializadas. ; This article analyses the decision-making process of regulatory agencies and the new perspectives perceived in the latest legislative changes. Through the theoretical-descriptive method, the relationships established between Law, Economics and Regulation are presented in order to understand the reasons that led to the institutionalization of Agencies. After presenting the main characteristics of these institutions, the administrative process is studied and defined as a legal institute that disciplines and establishes the sequence of facts and administrative acts prior to decision-making by the Public Administration. After establishing premises, the study explores the decision-making process of the Agencies and the new legal parameters that brought realistic, consequentialist and efficient contours to the action of these specialized Authorities. ; d |
