This paper aims to reflect, on the basis of contributions from psychoanalysis, on certain effectsof the growing role given to the victim in criminal proceedings, recognized by several authors as a trend in Latin American procedural law reforms. Without prejudice to acknowledging the existence of other problematic aspects, the aim will be to reflect on the situation of the relatives of those who suffer a violent death, who decide to assume the role of private accusers inthe criminal process and the consequences that this intervention may have on their mourningprocess. From the conception that legal knowledge is limited in understanding the effects oflegal solutions, insofar as the law acts on the social and individual life of its addressees, thecontribution that psychoanalysis can make in this regard will be drawn upon. With these inputs,certain guidelines will be proposed that are considered useful for the design of a policy and institutional framework to accompany the victim, which will reduce the possible harmful effectsthat their placement in criminal proceedings may have on their mourning process. ; El presente artículo se propone reflexionar, a partir de aportes del psicoanálisis, sobre ciertos efectos del creciente papel otorgado a la víctima en el proceso penal, reconocido por varios autores como una tendencia de las reformas legislativas procesales latinoamericanas. Sin perjuicio de reconocer la existencia de otros aspectos problemáticos, el objeto será reflexionar sobre la situación de los familiares de quienes sufrieran una muerte violenta, que deciden asumir el rol de acusadores privados en el proceso penal y las consecuencias que esa intervención puede tener en su proceso de duelo. Desde la concepción de que el conocimiento jurídico resulta limitado para entender los efectos de las soluciones legales, en tanto el derecho actúa en la vida social e individual de sus destinatarios, se acudirá a la contribución que al respecto puede brindar el psicoanálisis.
