الوصف: | LL.B. ; This paper delves into gender oriented crimes with particular reference to Rape and Female Genital Mutilation, in which victims are predominantly females. No reference will be made to gender based crimes such as human trafficking, forced pregnancy, forced sterilization, sexual violence or sexual slavery. Legislation and case law will be analysed and recommendations for changes in the law suggested, in order to help overcome issues that parties and courts might face prior to, during and after the proceedings. Local legislation on rape and female genital mutilation is compared to that of other Member States, with particular focus to that of the United Kingdom. Great significance is given to local laws dealing with the offences of Rape and Female Genital Mutilation within the Chapter 9 of The Laws of Malta, which has been recently amended through the ratification of the Istanbul Convention and the enactment of The Gender-Based Violence and Domestic Violence Act (Chapter 581 of The Laws of Malta). Rape cases are increasing steadily, however, no cases implementing the new laws have reached a final judgment at the time of writing. Furthermore, cases dealing with female genital mutilation have never yet found their way to Malta’s Courts. Albeit this, Malta has the highest rate of females which are at risk of undergoing the procedure, which will possibly result in our Courts having to deal with such a case in the future. Findings reveal that although these amendments within the law brought about improvements in legislation and sentencing, certain significant legal notions have failed to be included, and will therefore be delved into throughout the paper. Methodological instruments used consist of legislative analysis, case analysis and secondary qualitative research. ; N/A |
