عملية استرداد العائدات الإجرامية المهربة إلى الخارج مسار قانوني معقد، ويعد من أهم مظاهر مكافحة الفساد ذلك أن نجاح عملية المكافحة يقترن بالجدية والفعالية في استرداد الأموال المهربة التي تحصل عليها مرتكبو جرائم الفساد باعتبارها مسعى سياسي ومطلب اجتماعي عارم ، لذلك يتعين بعد الإقرار بفشل آليات العدالة الجنائية التقليدية في استعادة تلك الأموال، إتباع أسلوب آخر أثبت نجاعته يتمثل في الصلح الجزائي مع المهتمين بذلك، باعتباره أسلوب مرن تعتمده العدالة الجنائية الرضائية لتحقيق أهداف السياسة الجنائية المتبعة بموجب إجراءات مبسطة و يحقق أهدافه في فترة زمنية قصيرة. ; The process of recovering the proceeds of corruption offences abroad is considered the most important manifestation of the fight against corruption because of its legal, political and social importance, but the experience to prove that it remains. A complex and ineffective path. Therefore, the tools of traditional criminal justice have not led to this end, hence the interest of adopting another approach that is based on the mechanisms that provide justice, Restorative, notably through the criminal reconciliation that is deemed to be a Rapid justice, The Court of Justice of the European Communities. ; Le processus de récupération des produits des infractions liées à la corruption se trouvant à l’étranger est considéré comme la plus importante manifestation de la lutte contre la corruption du fait de son importance juridique, politique et sociale. Néanmoins l’expérience à démontrer qu’elle demeure une voie complexe et inefficace. Dès lors que les outils de la justice pénale classique n’ont pas abouti à cette fin. Il est préconise d’adopter une autre approche qui repose sur les mécanismes qu’offre la justice restaurative, notamment la réconciliation pénale qui est réputée être une justice Rapide, souple et efficace, les éléments nécessaires pour une politique pénale moderne. |
