Diplomová práce se věnuje souběhu pracovněprávního vztahu a výkonu funkce statutárního orgánu. Představuje "de lege lata" stranu pracovněprávního vztah a i stranu funkce statutárního orgánu. Soustředí se na judikaturu, která upravuje tuto problematiku a ukazuje její vývoj. Diplomová práce se zabývá i zahraničním exkurzem v rámci této problematiky, do Slovenské republiky a následně i k rozhodnutím Soudního dvora EU. Rozebírá právní aspekty souběhu a na závěr na základě všech předchozích podnětů je zamyšlení nad úpravou "de lege ferenda". ; Obhájeno ; The diploma thesis is devoted to the concurrence of employment relationship and the office of governing body. It represents the "de lege lata" side of the employment relationship and also the side of the function of the statutory body. It focuses on the jurisprudence that governs this issue and shows its development. The diploma thesis also deals with a foreign excursion within the framework of this issue, to the Slovak Republic and subsequently to the decision of the Court of Justice of the EU. It discusses the legal aspects of the concurrence, and finally, based on all the previous suggestions, there is a reflection on the "de lege ferenda" adjustment. |
