From the simple need to legally solve the problem of transferring land from ager publicum for the construction of houses, the institution of the right of surface has acquired over the centuries a meaning and “legal cloak” able to cover all situations in which those in need to build, plant or install certain things on the surface or surface of a land, do not have land. The importance of the right to surface cannot be ignored in the context in which the vast majority of the world’s states regulate and apply it extensively, constantly examining and researching it with the desire to bring it to perfection and maximum utility for civil relations established in the use of another’s land. Doctrinally, but also legislatively, the discussions on the problem of determining exactly the object of the surface, but also of the holder of the property right over the construction built on another’s land, have not been concluded yet. If in the wording of the Moldovan Civil Code, until March 1, 2019, our legislator showed a neutral position, but at the same time confusing, after this date, it implies that the right to construction belongs with ownership to the surface for the entire duration of the surface. , which in our opinion remains a debatable issue, which determines us to come up with some of our own opinions on the issue. |
