| الوصف: | In his commentary on the story of the woman taken in adultery in John's Gospel, Jean-Yves Leloup wrote: "Where the Pharisees see a fault that must be condemned, Jesus sees a misfortune that needs to be healed. They only see the sin, they don't see the suffering. Jesus sees the suffering and looks with humility on the sin. He does not seek to kill the woman, he seeks for a way to heal her, to deliver her." Yet some people still say that drug users should be punished because they are accomplices of drug dealers. However, in setting out a framework for the "legalization/regulation" of all drug use, the State would be in charge of drug production and distribution. Drugs deemed illegal today would have the same status as tobacco and alcohol. From that point forwards drug users would become users of this "public service", and therefore exemplary citizens participating in the growth of French national GDP. Since the law of December 31, 1970, which echoed Nixon's formula "we must wage war on drugs", the repression of drug use has gone from strength to strength in France. This law, now repealed to allow for a process of codification, was not preceded by an impact study. Yet, In terms of public policy we need to know whether this crackdown on drug use is effective. This thesis seeks to answer this question. Moreover, from a legal point of view, isn't reform essential if the question of the effectiveness of the law on drug use arises? Is there proportionality between the protection of public order in the face of simple drug use and the protection of users' public rights and freedoms? On December 5, 2023, the International Drug Policy Consortium published a report evaluating the United Nations' drug strategy. The report highlights the complacency of governments in continuing the war on drugs, despite the disastrous consequences in terms of health, discrimination and human rights.
