| الوصف: | 2016年12月25日,全国人民代表大会常务委员会《关于在北京市、山西省、浙江省开展国家监察体制改革试点工作的决定》(下文简称试点决定)颁布实施以来,学术界和实务界围绕国家监察委员会的性质、地位、组织、职权和体制等问题展开了学术讨论和争鸣。由于监察体制是监察制度的核心,不同的监察体制形成不同的监察制度,因此,为了深入理解国家监察委员会的职能和特征,有必要讨论监察委员会体制在我国监察史上的地位及其对当下中国宪制的影响。本文从宪法史的角度观察我国近代以来特别是建国以来监察体制的变化和发展,认为我国的监察体制经历了从古代的监察御史体制到近代监察院体制再到建国以来的行政监察体制的演变,其主要特点是设置专门的监察机构纠举官员的违法失职和贪腐行为,形成世界法制史上独一无二的独立监察体制和监察文化。在此基础上,通过比较国家监察委员会与以往监察机构的异同,认为国家监察委员会是一种新型的独立监察体制,其宪法地位、组织架构和权力行使方式具有鲜明的时代特征。 ; There has been a heated discussion on the nature, status, and function of the Supervisory Committee in the academia since the document on pilot reform of the national supervision system has been issued by the NPC Standing Committee in December 25th, 2016. The key problems on which this article concentrates are as follows. As a newly established supervisory organ, what supervision system does the Supervisory Committee belong to？ What are the characteristics of the Supervisory Committee in comparing with historical supervision system, especially supervision system since the founding of the People＇s Republic of China？ This article tries to analyze the evolution of Chinese supervision system since the modern time from a perspective of constitutional history, and to discuss the regular pattern of the development of Chinese supervision system. This article analyzes the system of Supervisory Committee on the basis of an analysis of Chinese administrative supervision system. To centralize the resources of anti-corruption, the reform of supervision system is imperative because of the innate defect of administrative supervision system. The main object of the pilot reform of the national supervision system is to transform the administrative supervision system into independent supervision system.
