| الوصف: | Economic theory, which offers grounds for economic policy, has undergone important changes since the emergence of macroeconomics in the period between the two world wars in the twentieth century. Notwithstanding the subsequent elaboration of new legal ideas about the economy, lawyers have been constrained by their limited capacity of forming normative judgements on violations of fundamental rights arising from the impact of macroeconomic policies. This paper discusses the relations between legal perspectives formed in recent decades that focus on economic subjects and proposes preliminary ideas by which lawyers can begin to approach analytically the role of macroeconomic policy in damping down the effectiveness of fundamental rights. The paper also describes analytical and model-building tasks that may be useful in the treatment of legal issues arising from the impact of macroeconomic policies. ; A teoria econômica, em que se fundamenta a política econômica, sofreu mudanças importantes desde a ascensão da macroeconomia no período entre as duas guerras mundiais do século XX. Contudo, mesmo após o subsequente surgimento de novas ideias jurídicas sobre a economia, juristas se defrontam com limitações à sua capacidade de formação de juízos normativos sobre violações a direitos fundamentais que sofrem impactos de políticas macroeconômicas. O presente trabalho discute conceitos das perspectivas jurídicas surgidas nas últimas décadas, que focalizam temas econômicos, e propõe ideias preliminares para que juristas passem a abordar analiticamente o papel da política macroeconômica na obliteração da efetividade de direitos fundamentais. Além disso, o trabalho descreve tarefas analíticas e construtivas úteis no tratamento de questões jurídicas relacionadas a impactos de políticas macroeconômicas. |
