The article deals with the legal regime applicable to people with mental disorders in the criminal execution phase. In order to do so, it explores the existing contradictions between the legal regime of the Penal Code and the Anti-Asylum Law and their respective logics that are radically opposed in terms of foundations and practices. Due to the persistence of security measures in the material reality of the criminal justice system, the article seeks to find concrete legal answers to make them compatible with the anti-asylum paradigm and its consequent realization of the freedom and fundamental rights of people with mental disorders. The article adopts the dual guarantee regime, according to which security measures must respect all criminal and procedural criminal rights and guarantees in order to prevent the treatment given to the non-attributable from being more severe than that of the imputable or semi-attributable, at the same time that, as they are applied to especially vulnerable people, the norms provided for in the legislation that protect people with disabilities and mental disorders should also apply to them. Based on this regime, the main controversies regarding the implementation of security measures are faced and solutions are proposed for the minimum period of hospitalization, hospitalization for non-compliance with outpatient treatment and the incidence of rights of the progressive system. ; O artigo tem por objeto o regime jurídico aplicável às pessoas com transtorno mental na fase de execução penal. Para tanto, explora as contradições existentes entre o regime jurídico do Código Penal e da Lei Antimanicomial e suas respectivas lógicas que se opõem radicalmente em termos de fundamentos e práticas.
