| الوصف: | This study aims to analyze objectivity as a basic instrument of legal hermeneutics, based on the reading of authors Emilio Betti and Hans-George Gadamer. The study makes an open analysis of the opposition of thought between the two authors and the importance of the debate between their opposing hermeneutics as essential contributions to legal hermeneutics and its objective interpretation. Therefore, the research will make use of a bibliographical analysis, with a critical-reflective approach based on the works of hermeneutics and the theory of the norm that reflected on the contributions of Emilio Betti and Gadamer for the legal interpretation. ; O presente estudo tem por objetivo analisar a objetividade como instrumento basilar da hermenêutica jurídica, a partir da leitura dos autores Emilio Betti e Hans-George Gadamer. O estudo faz uma análise descortinada da oposição de pensamento entre os dois autores e a importância do debate entre as suas vertentes hermenêuticas opostas como contributos essenciais para a hermenêutica jurídica e a sua interpretação objetiva. Para tanto, a pesquisa se valerá de uma análise bibliográfica, com uma abordagem crítico-reflexiva a partir da obras dos cultores da hermenêutica e da teoria da norma que refletiram sobre as contribuições de Emilio Betti e Gadamer para a interpretação jurídica. |
