However, public administration cannot be identified with procedural activities carried out by institutions of the executive, therefore, in authors‘ opinion, legal regulation of both law institutes at level of principles is impossible in one codified legal act. Administrative courts hear complaints concerning decisions by institutions of the executive imposing administrative sanctions. However, both legal doctrine and jurisprudence of administrative courts recognize that proceedings of administrative law offences and criminal procedure have more similarities than distinctions. While analyzing the tendencies in improving the legal regulation of proceedings of administrative law offences, in authors‘ opinion, it is vital to take into account the fact that administrative liability is conferred not only by the Code of Administrative Law Offences but also by other specialized laws which determine the imposition of economical sanctions but, regrettably, do not provide for the detailed procedure how to impose them. This can be recognized as a legal gap. The authors arrive at the conclusion that in the perspective development of imposition of economical sanctions, the procedure of reviewing the lawfulness for those sanctions and the proceedings of administrative law offences should be resolved in a complex manner – the imposition of both economical sanctions and administrative penalties as well as the procedure of reviewing the legality of those sanctions should be regulated by one separate legal act. |
