L aw is based upon two main pillars—(a) equality before the eyes of law.i.e. all are equal before law irrespective of their caste, creed, sex, place of birth, religion etc. and (b) equal protection from law. Law must be gender sensitive. The article in this edited volume will basically focus on what is law and how pragmatic it is in eschewing Gender Based Violence (GBV). Gender Discrimination is just one side of the story if you want to delve deep into a gruesome form of Violence. There is no doubt that there a paradigmatic shift from Gender Equality to Gender Neutrality. Even the Third Gender has to be brought under purview. Binary lens of Gender has gone non binary. The concluding part is basically a probe focussing on the efficacy of laws. There are certain pertinent questions that are raised like-is there any lacuna in laws that were implemented since pre independence era till date. Addressing the moot question whether implemented laws are gender sensitive or not adds fuel to fire thus enhances gender inequality. A critical review is the crying need of the hour. Formal equality is not the panacea rather women centric issues have to be highlighted. |
