| الوصف: | La justicia climática evidencia una problemática más del binomio derecho y globalización, que pone de presente el surgimiento de conflictos climáticos como consecuencia de medidas de mitigación y adaptación. Por esta razón el cambio climático viene siendo un asunto controversial y polémico en la intervención judicial en la esfera global y en cada uno de los países, convirtiéndose en la manifestación de la justicia ambiental “prioritaria” y posmoderna. Por ello, el presente artículo tiene como objetivo central analizar el contenido y alcance de la justicia climática en el marco del litigio estratégico, los estándares de acceso a la justicia ambiental y cuatro casos judiciales representativos sobre cambio climático. ; Climate justice shows one more problem in the binomial Law and Globalization, which highlights the emergence of climate conflicts as a consequence of mitigation and adaptation measures. For this reason, climate change has been a controversial and controversial issue in judicial intervention in the global sphere and in each of the countries; becoming the manifestation of “priority” and postmodern environmental justice. Therefore, the present objective is to analyze the content and scope of climate justice in the context of strategic litigation, standards of access to environmental justice and four representative court cases on climate change. |
