Este trabajo aborda las relaciones actuales entre medio ambiente y urbanismo. La protección del medio ambiente constituye un límite claro para el Derecho Urbanístico, que debe integrar en sus contenidos cuestiones como la evaluación ambiental de proyectos, planes y programas, la información y la participación pública, la protección de suelos, o la prevención y el control integrados de la contaminación. A través de este estudio de las principales novedades normativas —con especial atención a la Ley de Suelo de 2008— y de la jurisprudencia reciente, se demuestra como Urbanismo y Medio Ambiente son dos realidades jurídicas complementarias e inseparables. ; This paper is focussed on current juridical relationships between environment and urban planning. The protection of the environment constitutes a clear limit to Urban Law, which must integrate into its contents several issues such as environmental evaluation of projects, plans and programmes, freedom of information and public participation in decision-making, soils protection, or integrated pollution prevention and control. Through the present study, including the newest and the most important regulations —with special attention to the Soil Act of 2008— and the recent judicial decisions, we can conclude that Environmental Law and Urban Law are two complementary and indivisible disciplines. |
