| الوصف: | In the present investigation, conventionality control will be analyzed, which is a theoretical-legal concept developed by the Inter-American Court of Human Rights (IACHR Court), whose main objective is to ensure the conformity of national law with international human rights law. In this analysis, we seek to examine this institution and its relationship with mistreatment, insults and assaults on the agents in charge of safeguarding public order in the exercise of their functions. According to article 394, paragraph 2 of the Comprehensive Organic Penal Code (COIP), people who mistreat, insult or physically attack agents in charge of maintaining public order during the exercise of their duties, will be punished with a prison sentence of five to ten days. The objective of the investigation is to determine if there is an inconsistency with the principle of legality since the criminal norm established in numeral 2 of Article 394 of the Comprehensive Organic Criminal Code of Ecuador, in terms of a clear and precise delimitation of the elements of the conduct. criminally prohibited according to the criteria issued by the Inter-American Court of Human Rights. En este análisis, se busca examinar esta institución y su relación con los maltratos, insultos y agresiones de obra a los agentes encargados de precautelar el orden público en el ejercicio de sus funciones.
