The author, assuming a critic position, takes unto himselfthe study ofthe International PenalJurisdiction based upon the concept of the Social State of Right. To achieve such a task, he elaborates an investigation (inquiry) around the relationship that exists between the tendency to universalize control mechanisms, such as the penal system through the creation of an international court; and the process of globalizing the political, social and economical relationships. To conclude that there is some sort of coupling from within the constitutional theory in order to make this purpose be carried out without great traumatisms. ; El autor asumiendo una posición crítica asume el estudio de la jurisdicción penal internacional a la luz del concepto Estado Social de Derecho. Para ello elabora una indagación en tomo a la relación que existe entre la tendencia a universalizar mecanismos de control, como el sistema penal mediante la creación de una corte internacional, y el proceso de globalización de las relaciones políticas, sociales y económicas. Para concluir que existe una especie de acoplamiento desde la teoría constitucional para lograr que este cometido se lleve a cabo sin mayores traumatismos. |
