This article pretends to discover the real nature of the Intellectual Property rights; the principles to solve the necessary balance between the public and private rights and interests and the immaterial nature of that special property in relation to the problem of illegal loading from the net. The question to solve the problem of illegal copies it is not relation with the facilities of the new technologies, it is because our legislator is unknown the special characteristics of the intellectual property. ; El presente artículo tiene por finalidad descubrir en la propia naturaleza jurídica de la Propiedad Intelectual las claves para dar un adecuado tratamiento legislativo al necesario equilibrio que requieren estos derechos, donde se conjuga lo público y lo privado con la inmaterialidad del objeto que se protege, siendo coherentes con su verdadera especialidad de cara a afrontar el actual problema de las descargas ilegales en red. El problema de estas reproducciones ilegales no responde tanto a la facilidad que ofrecen las nuevas tecnologías como al apartamiento que nuestro legislador viene haciendo desde hace unos años, desconociendo en qué consiste la especialidad de los derechos intelectuales. |
