内容摘要 伴随着国际死刑废除潮流的冲击以及国内人权意识的觉醒，国内法律界掀起了死刑存废之争，不少专家学者纷纷建议从立法上直接废除死刑，然而其中较少论及我国的社会现状以及人民对于死刑存废的意愿。本文意图从司法的角度，通过在死刑案件中适用陪审团制度，让人民群众充分参与死刑案件的具体审判并表达意愿。死刑案件的审判过程中，人民群众应当有所作为。 本文除引言和结论之外，一共分为四章： 第一章探讨了死刑案件适用陪审团制度的必要性。内容分为四节，分别从汇集民意、促进司法民主的实现、保障司法公正以及提升死刑案件审判的公信力等四个角度，深入分析了陪审团制度建构之必要性。 第二章探讨了死刑案件适用陪审团制. ; ABSTRACT Along with the international trends of the abolition of death penalty as well as the domestic human rights consciousness, the legal profession in China set off the debate on the abolition of death penalty.
