| الوصف: | El Real Decreto Legislativo 1/2020, de 5 de mayo, por el que se aprueba el Texto Refundido de la Ley Concursal incorpora importantes novedades en materia laboral. Entre ellas, las que tienen que ver con la venta de la unidad productiva en sede concursal. En este trabajo, se analizan las nuevas reglas competenciales en la materia y la limitación de la responsabilidad del adquirente. La innovación que, al respecto, plantea la norma concursal, sin embargo, arroja ciertas dudas sobre la existencia de un posible supuesto de ultra vires. Por lo demás, en este trabajo también se va a dar oportuna cuenta del tratamiento que se le dispensa en la norma al personal de alta dirección y a la introducción que se efectúa de la figura del director general. Bankruptcy Law incorporates important developments in the labour field. Some of them related to the sale of operating units during insolvency stages. This work analyses the new regulations and the limitation of the buyer¿s liability. However, the new Bankruptcy Law casts doubt on the existence of a possible ultra vires case.
