| الوصف: | 1990’lı yılların başında cep telefonlarının ve bu telefonlarda oynanmak üzere geliştirilen mobil oyunların üretilmesiyle beraber mobil oyun çağı başlamıştır. Daha sonra akıllı telefonların geliştirilmesiyle beraber sektör ciddi bir değişim yaşamıştır. Mobil oyun pazarının ekonomik olarak da çok büyük bir pazar hâline gelmesi, doğal olarak, çeşitli hukuki uyuşmazlıkları da beraberinde getirmiştir. Hukuk düzeninin görece yeni karşılaştığı bir kavram olması hasebiyle mobil oyunlara ilişkin hukuki korumanın ne şekilde ve hangi kapsamda yapılabileceğine dair bir belirsizlik bulunmaktadır. Ayrıca mobil oyunların fikri mülkiyet hukukunun pek çok alanını ilgilendirmesi de meseleyi daha da karmaşık bir hâle getirmektedir. Bu çalışmada mobil oyun kavramı incelenecek, daha sonra fikri mülkiyet hukuku çerçevesinde korumanın hangi kapsamda yapılacağı tartışılacaktır. In the early 1990s, the mobile gaming era began with the production of cell phones and mobile games developed to be played on these phones. Later, with the development of smartphones, the sector experienced a serious change. The fact that the mobile gaming market has grew very large economically has naturally led to various legal disputes. Since it is a relatively new concept for the legal system, there is an uncertainty regarding the manner and scope of legal protection for mobile games. Also, mobile games concern many spheres of intellectual property law and that makes this issue even more complicated. In this study, firstly very notion of mobile games will be examined, and then the scope of legal protection of mobile games under intellectual property law will be discussed. |
