| الوصف: | UFU - Universidade Federal de Uberlândia O objetivo da dissertação é estudar a teoria do diálogo das fontes como método de interpretação e aplicação de normas jurídicas, visando a contribuir para que o Direito avance em relação ao enfrentamento do desafio de proteger a pessoa humana e buscar soluções mais justas e conforme os direitos fundamentais, especialmente na promoção da pessoa com deficiência. Utilizou-se o método dedutivo como método de abordagem e o monográfico como método de procedimento. Além disso, em se tratando da análise de direitos fundamentais, impôs-se a utilização da argumentação jurídica, em face à dificuldade interpretativa e à aplicação adequada de princípios. Verificou-se que o diálogo das fontes consiste em meio de realização de direitos fundamentais, uma vez que se trata de método de interpretação e aplicação de normas jurídicas capaz de dar respostas em consonância com o desafio hodierno do Direito de proteção da pessoa humana e busca de soluções adequadas e conforme a Constituição. Concluiu-se que o diálogo das fontes é igualmente capaz de (res)sistematizar as normas do novo modelo jurídico promocional das pessoas com deficiência, em razão dos valores jurídicos inerentes a essas pessoas e dos valores estatuídos pela Constituição da República e pela Convenção Internacional sobre os Direitos das Pessoas com Deficiência. This master’s dissertation aims to address the theory of the “Dialogue des Sources” as an interpretation and application method of legal standards. In addition, it aims at helping Law advance in the challenge of protecting human beings and seeking solutions that are more just and in accordance with fundamental rights, especially in the protection and promotion of persons with disabilities. The deductive method was used as an approach and the monographic method was used as a procedure. Moreover, in the case of the analysis of fundamental rights, it was necessary to use legal arguments due to difficulty of interpretation and proper application of principles. The “Dialogue des Sources” proved to be an instrument for the execution of fundamental rights, since it is a method of interpretation and application of legal norms that solves issues in accordance with the current challenge of the right of protection of human beings and promotes the search of just solutions consistent with the Constitution. In conclusion, the “Dialogue des Sources” can also redesign the norms of the new legal model for the promotion of persons with disabilities due to the legal values inherent to these persons and to the values established by the Constitution and by the International Convention on the Rights of Persons with Disabilities.
