| الوصف: | Статья посвящена одной из проблем гражданского права - истолкованию понятия «недвижимость»: в гражданском законодательстве оно встречается в разных значениях, что приводит к его неоднозначному толкованию. В результате этого возникают сложности правоприменения, а судебная практика во многом зависит от субъективного мнения судей и понимания термина «недвижимость». В статье, помимо общенаучных методов познания, впервые предложены более широкие теоретические подходы к пониманию феномена недвижимости. Во-первых, недвижимость рассматривается в виде функциональной характеристики взаимодействия элементов, составляющих его структуру. Во-вторых, понятие исследуется с позиций мерности, т.е. способности понятия иметь несколько значений (измерений) в зависимости от количества выделяемых ключевых слов, которые входят в определение понятия. Так, определение недвижимости, которое в ГК РФ формулировалось как отношение между вещью и землей, не учитывает противоположно направленное воздействие, т.е. земли на вещь. Обоснована необходимость включения в структуру определения параметра, который бы характеризовал влияние этого воздействия. На основе проведенного структурного исследования сформулировано авторское определение недвижимости в форме принципа (правила). Предложены варианты практического использования полученных результатов для определения недвижимости объектов для целей гражданского оборота. As the title implies the article describes the concept of real estate from the point of view of characterizing an object. It touches upon one of the problematic issues of the civil law dealing with interpretation of the notion under discussion. It stems from the fact that in the civil law the concept appears in quite different meanings which results in an ambiguity of its interpretation. As such, there emerge difficulties in law enforcement activities while judicial practice depends largely on a subjective opinion of judges and on their understanding of the term "real estate". For the first time broader theoretical approaches to understanding the phenomenon of real estate as immovables are presented in the article in addition to universal scientific research methods. Firstly, real estate is considered as a functional characteristic of interaction between elements that compose its structure. Secondly, the concept is studied through the lenses of dimensions, i.e. from the point of view of its capability to have several meanings (dimensions) depending on the number of the definition of the concept consists of. Thus, the author proceeds from the fact that the definition of real estate, which was formulated in the civil code as a relationship between an object and land (immovable), does not however address the opposite impact of the land on an object. In this regard the author reiterates and justifies the need to improve the definition by including a clear relevant parameter into the structure whereof so that to describe the influence of the land. On the basis of the structural study carried out by the author his own definition of real estate in the form of a guideline (a rule) has been introduced with a set of options being proposed covering the use of the results obtained in order to give determination of real estate with the focus on the feature and quality of objects for the purposes of civil turnover ЖУРНАЛ ПРАВОВЫХ И ЭКОНОМИЧЕСКИХ ИССЛЕДОВАНИЙ, Выпуск 2 2020 |
