The article in the Chilean Journal of Law addresses the illegality of minors' consent to irreversible transgender medical interventions in Chile. It discusses the lack of scientific evidence on the safety and effectiveness of these treatments, questioning the informed consent of minors. It emphasizes the importance of evaluating minors' decision-making capacity and respecting their progressive autonomy, as well as the medical and ethical responsibility in the care of minors with gender dysphoria. Las modificaciones legales introducidas por la Ley Nº 21.331 de Salud Mental, reconocen el derecho a la autonomía progresiva de niños, niñas y adolescentes (NNA) en materia de asentimiento, conservando el ejercicio del consentimiento informado en sus padres o representantes legales y haciendo ilegal, incluso con la autorización de estos, cualquier procedimiento que implique su esterilización. Sin embargo, en el contexto del trastorno de identidad o disforia de género, algunos profesionales de la medicina en Chile están recetando a NNA medicamentos y cirugías que, sobre la base del "enfoque afirmativo", prescinde de los requisitos legales y consensuados por la bioética clínica sobre consentimiento informado y promueve iniciar tratamientos sin contar con un diagnóstico, sin evaluación de la capacidad del paciente y sin evidencia científica sobre su seguridad y efectividad. En este trabajo se argumenta que el inicio de procesos de transición de género potencialmente dañinos en menores de edad, supone desafiar la ley vigente sobre consentimiento informado y capacidad legal, así como el interés superior del niño en el contexto sanitario.
