| Abstract (English): |
The present study deals with the international legal treatment given to the right to water and the evolution of its political-legal conception, initially understood under an economicist bias until its recent acceptance as a human right. The characteristics and contours of the human right to water, the crisis faced in relation to the scarcity of this fundamental good and the issue of charging for water resources as opposed to guaranteeing universal and non-discriminatory access, are also the object of analysis. The need for States to adopt a more active stance to realize the human right to water is finally called for, recognizing that the mere formal declaration as a human right is insufficient to provide effective protection to water and unable to ensure it for future generations. O presente estudo versa sobre o tratamento jurídico internacional conferido ao direito à água e a evolução de sua concepção político-jurídica, inicialmente compreendida sob um viés economicista até sua aceitação recente como direito humano. As características e contornos do direito humano à água, a crise enfrentada com relação à escassez deste bem fundamental e a questão relativa à cobrança pelos recursos hídricos em contraposição à garantia de acesso universal e não discriminatório, são também objeto de análise. A necessidade de que os Estados adotem postura mais ativa de concretização do direito humano à água é ao final conclamada, reconhecendo-se que a mera declaração formal como direito humano é insuficiente para conferir efetiva proteção à água e incapaz de assegurá-la às gerações futuras.
