| Abstract (English): |
The Arab Charter on Human Rights (ACHR) of 2004, which became effective in 2008, marks a critical step in the process of promoting and protecting human rights in the Arab world. The United Arab Emirates (UAE) played an important role drafting the Charter and has been keen on incorporating its provisions into its internal legislation since its ratification in 2008. By emphasizing the significant role that the UAE played in the development and implementation of the Arab Charter on Human Rights (ACHR) of 2004, the study aimed to clarify the role of the UAE and its participation as an Arab state and member of the Arab League in respecting and promoting the human rights system. The study ended with various conclusions, including the following: the UAE played a significant role in the creation of the ACHR of 2004, which represents a significant Arab step in ensuring the respect and enhancement of human rights in the Arab world. Moreover, the ACHR aligns with the international commitments established by the UN Conventions, which states that member states shall put the provisions of these commitments into practice. The study also provided several recommendations, including the necessity for all legislation in the UAE to be consistent with the ACHR's provisions, demonstrating a deep commitment to the principles and provisions outlined in the Charter. يأتي الميثاق العربي لحقوق الإنسان لعام 2004م لكي يشكل خطوة مهمة في مسيرة تعزيز وحماية حقوق الإنسان في الوطن العربي، والذي دخل حيز النفاذ في عام 2008م. وقد بذلت دولة الإمارات دورا بارزا في إعداد مشروع الميثاق، كما حرصت الإمارات على تفعيل نصوص على الميثاق في تشريعاتها الداخلية منذ تصديقها عليه في عام 2008م وهدفت الدراسة إلى بيان دور دولة الإمارات العربية ومشاركتها كدولة عربية عضو في منظمة جامعة الدول العربية، في مجال احترام وتعزيز منظومة حقوق الإنسان، وذلك من خلال تبيان الدور الهام الذي لعبته دولة الإمارات العربية في إعداد وتنفيذ الميثاق العربي لحقوق الإنسان لعام 2004 وخلصت الدراسة إلى عدة نتائج منها أن لدولة الإمارات دورًا مهما في ظهور الميثاق العربي إلى أرض الواقع، هذا بالإضافة إلى أن الميثاق العربي لسنة 2004م يعد خطوة عربية بالغة الأهمية، لضمان احترام وتعزيز حماية حقوق الإنسان في الوطن العربي. كما يتفق الميثاق العربي مع ما جاء في الالتزامات الدولية المقررة بموجب الاتفاقيات الأممية من ضرورة تنفيذ الدول الأعضاء المضمون هذه الالتزامات وانتهت إلى العديد من التوصيات أهمها ضرورة اتساق التشريعات الداخلية كافة لدى دولة الإمارات العربية المتحدة مع أحكام الميثاق، والتي تؤكد عمق الالتزام بماورد في الميثاق من مبادئ وأحكام.
