| Abstract (English): |
This study aims to examine the fatwa document issued by the scholars of the Arab Maghreb (Morocco) against Sultan Abdul Hamid II (1876-1909), criminalizing Hejaz Railway construction. It also highlights the use of religious fatwas to hinder the modernization Arabian Peninsula transportation, serving the interests of Britain which oppose the Hejaz Railway project. For the study purposes, the historical descriptive analytical research approach was adopted. The study consists of an introduction, four sections, and a conclusion. The introduction states the research problem, objectives, and significance. The first section presents the literal text of the document and its critique. The second section defines the terminology used in the document. The third section examines the context of the document, while the fourth and final section offers a historical analysis of the document. The study key findings showed that the document’s terminology was well defined and the historical ambiguities surrounding its content were analyzed. It was also concluded that the religious, political, and economic contexts and dimensions contained within the document were clarified. [ABSTRACT FROM AUTHOR] |

تهدف هذه الدراسة إلى تحقيق وثيقة فتوى علماء المغرب العربي ضد السلطان عبد الحميد الثاني (1876-1909م)، بتجريم إنشاء خط سكة حديد الحجاز، وتسليط الضوء على استخدام الفتوى الدينية لمنع تحديث وسائل المواصلات في الجزيرة العربية خدمة لمصالح بريطانيا المعارضة المشروع خط الحجاز، واقتضت الدراسة استخدام منهج البحث التاريخي وصفا وتحليلا لمضمون الوثيقة، واحتوت الدراسة على أربعة محاور ومقدمة وخاتمة تناولت المقدمة مشكلة البحث وأهدافه وأهميته، وتضمن المحور الأول النص الحرفي للوثيقة ونقدها، وخصص المحور الثاني للتعريف بمصطلحات الوثيقة، في حين درس المحور الثالث سياقات الوثيقة، أما المحور الرابع والأخير فخصص للتحليل التاريخي للوثيقة، وتوصلت الدراسة إلى نتائج من أهمها: التعريف بالمصطلحات التي وردت في مضامين الوثيقة وتحليل جوانب الغموض التي تكتنف مضمونها التاريخي، ومنها توضيح السياقات والأبعاد الدينية والسياسية والاقتصادية التي احتوتها.
