| Abstract (English): |
God Almighty legalized marriage and made it one of the highest contracts that a person seeks to conclude in his life, in order to preserve human offspring and the continuity of family life. Family, and the significant role of custom in expanding the areas of criteria considered in the qualities of competence in marriage, as well as the qualities of religiosity and morals, as it is necessary to take into account the qualities that necessitated temporal and spatial circumstances and the change of people’s customs, paying attention to them, including lineage, workmanship, age, educational attainment, and beauty, and others, until the purpose of marriage legislation is achieved, which is the intimacy, affection and tranquility that prevail in the family. ان الله سبحانه وتعالى شرع الزواج وجعله من اسمى العقود التي يسعى الانسان الى ابرامه في حياته، وذلك للحفاظ على النسل البشري وديمومة الحياة الاسرية، فجعل له ضوابطاً وشروطاً لابد من ان تتوفر فيه لتضمن استمراريته وديمومته، ومن ذلك الكفاءة في الزواج ودورها في الحفاظ على الروابط الأسرية، وما للعرف من دور بالغ في التوسعة من مجالات المعايير المعتبرة في صفات الكفاءة في الزواج، فضلاً عن صفتي التدين والخلق، اذ يجب مراعاة صفات اقتضت الظروف الزمانية والمكانية وتغير اعراف الناس، الالتفات اليها منها النسب، والصنعة والسن، والتحصيل الدراسي، والجمال وغيرها، حتى يتحقق المقصود من تشريع الزواج وهو الالفة والمودة والسكينة التي تسود الاسرة.
