| Abstract (English): |
This study aims at examining both the possibilities of the endowment institution in endowing the means of production and its organizational regulations. The importance of this examination lies in shifting from the usage of simple tools or small projects to the usage of complex technological ones and mass production. The problem of this study concentrates on a number of jurisprudent points of view which prohibit resorting to such a type of endowment as well as the absence of a sufficient jurisprudent perspective in keeping up with modern technological developments in regard to the means of production for the purpose of endowment. The methodology adopted in the study is a descriptive one based on discussion and analysis. In addition, the study assumes that endowing the means of production contributes in improving the quality and amount of production provided by the endowment institution, especially in relation to agricultural lands. The results of the study show that the means of production which could be endowed represent movable assets of production which could be rented for a limited period of time, but not loaned. Furthermore, the study also finds that the endowment's loaning bonds contribute in financing the industrial sector at large. [ABSTRACT FROM AUTHOR] |

يهدف البحث التعرف الى إمكانات مؤسسة الوقف في مجال وقف الأدوات الإنتاجية ومعرفة الجوانب التنظيمية المتعلقة به. وتبرز أهمية وقف أدوات الإنتاج مق خلال الإسهام في الانتقال من استخدام الأدوات البسيطة أو المشروعات الصغيرة إلى استخدام الأدوات ذات التكنولوجيا المعقدة والإفادة من مزايا الإنتاج الكبير. وتنحصر مشكلة البحث في الآراء الفقهية التي تقوم بعدم جواز وقف المنقول، وعدم وجود رؤية فقهية كافية لمعرفة مدى التطور الحديث في أدوات الإنتاج، وكيفية توظيفه في العمل الوقفي. وتقوم منهجية البحث على الطريقة الوصفية المبنية على المناقشة والتحليل الاستقرائي. ويفترض البحث أن وقف أدوات الإنتاج يسهم في تحسين نوعية وحجم الإنتاج في العمل الوقفي، وبخاصة الأواني الزراعية. وقد توصل البحث إلي نتائج عديدة أهمها أن أدوات الإنتاج التي يمكن وقفها تمثل أصولا إنتاجية منقولة، وهي تقبل الإجارة ضمن فترة زمنية ولا تقبل القرض، كما أن سندات المقارضة المتعلقة بالوقف تسهم في تمويل القطاع الصناعي.
