The article discusses the expansion of interstitial exclusivities and its impact on intellectual property law in the U.S. An overview of the cases Bilski v. Kappos and Association for Molecular Pathology v. United States Patent and Trademark Office is presented. Under the provisions of preemption principles, states may create intellectual property laws including exclusivities in inventions without going against the Patent Act. The authors recommend the extension of state-law protections over inventions excluded from federal protection. |
