The author shares his thoughts concerning the 1969 case of Red Lion Broadcasting Co. v. FCC, which was already resolved by the Supreme Court of the U.S. He illustrates the similarity of law and ecology by using the landmark Red Lion case, saying that the case has lost its doctrinal niche when the FCC abandoned the Fairness Doctrine in 1987 and the D. C. Circuit set aside rules that had been at issue in the case. He claims that the case is now one of endangered decisions in communications law. |
