The article discusses the Badger v. PREIT Associates, LP case, wherein customer Josie Badger complains violation to the Americans with Disabilities Act (ADA) of retailer PREIT Associates LP. Badger claimed that architectural barriers hinders her safe access. The U.S. District Court of the Western District of Pennsylvania examined intent to return theory and deterrent effect test. The court also ruled PREIT's violation of the ADA for claiming an inaccessible parking space as accessible. |
