| الوصف: | The consequences of an economic crisis also have an impact on the legal sphere, leading to the revision of certain figures that had hitherto been rarely invoked, as well as the appearance of new ones. This figures make it possible to respond to changes that have occurred in property relations. The aim of this work is to study the supervening and extraordinary alteration of the basic circumstances of a contractual relationship. It starts from the rebus sic stantibus clause, in order to propose alternative solutions in those cases in which its influence on the dynamics of the contract is insufficient, given that, in our legal system, the protection of the debtor against the unforeseeable onerousness of his performance lacks specific legal regulation. In particular, we will examine the assumptions that, according to consolidated case law, must be met in order to admit the ineffectiveness of the contract, examining both the traditional doctrine on the rebus sic stantibus clause and the most recent jurisdictional pronouncements. Having carried out this examination, we will analyse the appropriateness of certain agreements between the parties that are aimed at ensuring the possibility of depriving a contract of its effectiveness when the circumstances that were taken into account have changed in an unforeseen manner, leading to an unfavourable situation, from an economic perspective, for one of the parties. These are the MAC clauses (material adverse change). ; Las consecuencias de una crisis económica también tienen incidencia en el ámbito jurídico, propiciando la revisión de ciertas figuras hasta entonces poco invocadas, así como la aparición de otras nuevas.
