The commented judgment reiterates one of the traditional problems of labor law: the proof of overtime. Said problem worsens with the introduction of the irregular working day in our productive system; although it intends to be resolved with the daily record of the working day. The question raised in this judgment is precisely the problem of the company's lack of registration. ; La sentencia comentada reitera uno de los problemas tradicionales del derecho del trabajo: la prueba de la realización de las horas extraordinarias. Dicho problema se agudiza con la introducción de la jornada irregular en nuestro sistema productivo; si bien pretende resolverse con el registro diario de jornada. La cuestión que se plantea en esta sentencia es, justamente, el problema de la ausencia de registro por parte de la empresa. |
